General traffic law: comprehensive and important area of law

Since we are all road users, general traffic law is of great importance to each of us. You may also need legal assistance as a road traffic victim, for example if you are hit as a pedestrian. As a driver, you sometimes have to enforce your rights against the other party involved in an accident or even against your own insurance company. Accordingly, there are different areas of law in general traffic law:

  • Civil traffic law specifically deals with liability law when it comes to compensation for damages and pain and suffering after a traffic accident, and it is also applied to contract law in relation to car purchases and leasing. This concerns the drafting of the contract and also associated warranty claims.

  • Traffic offenses law applies to fines, points in Flensburg and driving bans.

  • Traffic criminal law is important for offenses under Section 142 of the Criminal Code (unauthorized removal from the scene of an accident) and Sections 315 b, c of the Criminal Code (endangering road traffic with the threat of a driving ban or license revocation).

  • Traffic administration law deals with measures such as the revocation of driving licenses, towing measures and a logbook requirement.

  • Insurance law is part of general traffic law insofar as it relates to liability, partial and fully comprehensive motor vehicle insurance.

 

Other legal provisions may apply, such as those relating to traffic planning or road construction loads. This would be the case, among other things, if you suffered or caused an accident due to an inadequate road surface.

Which laws do we deal with in general traffic law?

As the different areas of law suggest, quite a number of different laws are applied in general traffic law. Essentially, the StVG (Road Traffic Act), the StVO (Road Traffic Regulations), the StVZO (Road Traffic Licensing Regulations), the FZV (Vehicle Registration Ordinance) and the FeV (Driving License Ordinance) are authoritative, all of which are components of regulatory law and therefore federal law. This means, among other things, that it doesn't matter where in the country a road traffic incident took place, the consequences of which we would like to help you with. The situation is different with the responsible authorities, which are located regionally and can become your opponents. The road traffic authority, the public order office and the public prosecutor's office, as well as private companies such as TÜV, which take on sovereign tasks, deal with the various legal areas.

When is it worth hiring a traffic law lawyer?

In each of the legal areas mentioned and in other, rare cases, we can at least help you with advice. There may be cases in which we advise you (very inexpensively) to “swallow” a fine. But there are numerous cases in which a road user accepts an unfounded decision, even though an objection and a lawsuit would have been worthwhile. The lawsuits surrounding measurement inaccuracies in speed checks alone fill many court filing cabinets. The devices are calibrated and accurate - claims the police. But in reality, their accuracy also depends on the light, the measurement method chosen and, above all, the traffic situation. You can easily see how inaccurate speed measurements can be if you compare the display on your speedometer with the (GPS-based) speed display on the navigation device - there is almost always a difference, but this varies greatly depending on the section of road . It may only be two to three km/h, but in the event of a speeding violation, such a difference can result in a driving ban or even the revocation of your driver's license.
